Comet Prompts – Terms of Service

1) Overview

These Terms of Service ("Terms") govern your access to and use of the Comet Prompts website, content, and services (the "Service"). By using the Service, you agree to these Terms.

2) Definitions

  • "Prompts" means prompt text, titles, tags, and related materials published by Comet Prompts or submitted by users.
  • "User Content" means any content you submit to us (e.g., prompts, text, tags, feedback, your name).
  • "Digital Products" means paid downloads such as prompt packs, templates, or ebooks.
  • "Consulting" means paid advisory or implementation services provided by us under an order, email confirmation, or statement of work ("SOW").

3) Eligibility

You must be at least 13 years old to use the Service and at least 18 to purchase. If you use the Service on behalf of another person or entity, you represent you have authority to bind them to these Terms.

4) License to You (Free Content)

Unless a page says otherwise, we grant you a non-exclusive, worldwide license to use, copy, modify, and create derivative works from our free Prompts for personal or commercial purposes, subject to these Terms and any third-party rights. We do not guarantee any Prompt is free of third-party rights.

5) Digital Products (Paid)

5.1 License

Upon payment, we grant you a personal-use license (non-transferable). No redistribution, resale, or sharing of Digital Products is permitted.

5.2 Delivery

Digital Products are delivered by download link or email to the address you provide. Ensure your email can receive messages from info@steeptek.com.

5.3 Refunds

You may request a refund within 14 days of purchase—no questions asked. Email info@steeptek.com with your order email and receipt ID.

5.4 Updates

We may provide minor updates at our discretion. Access to updates is not guaranteed unless stated at purchase.

6) Consulting

6.1 Scope & Fees

Consulting is governed by an order or SOW describing scope, deliverables, fees, and timeline. If a conflict exists, the SOW controls.

6.2 Materials & IP

We retain ownership of our pre-existing materials, know-how, and generic tools. After you pay in full, we grant you a non-exclusive license to use deliverables for your internal business. You may not resell or publicly distribute our deliverables without written permission.

6.3 Scheduling & Cancellations

Sessions cancelled or rescheduled with less than 24 hours notice may be charged.

6.4 Refunds

Unless the SOW says otherwise, consulting retainers are refundable for unused time within 30 days, less any services already provided. No refunds after services are performed.

7) Payments; Taxes

You authorize us and our payment processor (e.g., Gumroad, Stripe) to charge your payment method for amounts due, including applicable taxes. Prices may change prospectively. You're responsible for accurate billing details and any chargeback fees due to your error or unauthorized use of your account.

8) Your Submissions (User Content)

By submitting User Content, you represent and warrant that you own it or have all rights necessary and that it doesn't violate any law or rights of others (including IP, privacy, publicity, or confidentiality).

You grant Comet Prompts a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, royalty-free license to host, store, use, reproduce, adapt, publish, translate, distribute, publicly display, and create derivative works from your User Content to operate, improve, and promote the Service (including inclusion in prompt packs). You permit us to use your name (if provided) for reasonable attribution. To the extent permitted by law, you waive moral rights in User Content.

Do not submit confidential information you don't want published. Do not include personal data about others without permission.

9) Acceptable Use

  • Do not violate laws or third-party rights (including IP and privacy rights).
  • Do not submit or publish unlawful, harmful, deceptive, defamatory, or hateful content, or content involving minors.
  • Do not upload malware, interfere with the Service, or circumvent rate limits or access controls.
  • Do not scrape or harvest data except via documented public export features.
  • Do not use the Service to build or train competing models or services without written consent.
  • Do not misrepresent the source or attribution of prompts.

We may remove content or suspend access for violations.

10) Third-Party Services; No Affiliation

The Service may reference or link to third-party products or services (e.g., Perplexity, Gumroad, Stripe). Those are governed by their own terms. We are not affiliated with or endorsed by Perplexity. "Perplexity" and related marks are the property of their owners.

11) No Professional Advice

Prompts, Digital Products, and Consulting materials are for informational/educational purposes only and are not legal, medical, financial, or other professional advice. You are responsible for your use and results.

12) Disclaimers

THE SERVICE, DIGITAL PRODUCTS, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE RESULTS, ACCURACY, OR AVAILABILITY.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMET PROMPTS AND ITS OWNERS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE, DIGITAL PRODUCTS, OR CONSULTING WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT.

14) Indemnity

You will defend, indemnify, and hold harmless Comet Prompts from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.

15) DMCA / Copyright

If you believe content infringes your copyright, email info@steeptek.com with: (a) your contact info; (b) identification of the work and the allegedly infringing material; (c) a statement of good-faith belief; (d) a statement under penalty of perjury that the notice is accurate and you are authorized; and (e) your physical or electronic signature. We may remove content and terminate repeat infringers.

16) Privacy

Your use of the Service is also governed by our Privacy Policy.

17) Modification; Termination

We may modify the Service or these Terms at any time. For material changes, we'll post the new Terms with a new "Last updated" date and, when feasible, provide advance notice. Continued use after changes means you accept them. We may suspend or terminate the Service or your access at any time, with or without notice.

18) Governing Law; Venue

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflicts of law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Fairfax County, Virginia for any dispute not subject to arbitration.

19) Miscellaneous

These Terms are the entire agreement between you and Comet Prompts regarding the Service. If a provision is unenforceable, the remainder stays in effect. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, or sale. No waiver is implied by any delay or omission.
